Re: Accreditation of Professionals/Professional

Agencies for certifying F.E.A Installations

 

This refers to our circular no.FT/4/2002 dated 10-5-2002 allowing corporate offices of insurance companies to empanel professionals/ professional agencies for certifying F.E.A. Installations subject to complying with the norms stipulated in the said circular.

 

Insurers are requested to furnish a list of prossionals/professional agencies ( giving names, addresses and other qualifying details) accredited by them as on 31-12-2004.

Arising out of a representation from an insurer, for the sake of greater clarity, it has been decided to modify the above mentioned tariff entry to read as under:

Re: Section III - Rule 9(b) -Long Term Policy for Dwellings - All India Fire Tariff

Arising out of requests received from insurers it has been decided to modify with immediate effect rule no.9(b) of Section III of AIFT in respect of 'Long Term Policy for Dwellings'to read as under:

Rule 9(b): Refund on cancellation of Long term Policy at the request of the insured may be allowed subject to the following conditions:

  1. No refund shall be allowed if there has been a claim under the policy.

     

    1. If the policy is cancelled within 3 years of inception, the premium to be retained shall be worked out as per normal rates applicable - that is without allowing any discount.

     

    1. If the policy is cancelled after 3 years of inception, the discount slab shall be reworked for the number of years the policy was actually in force. For this purpose fraction of a year shall be rounded to the next higher year. For example if the policy has run for 3 years and 3 months, premium shall be retained for 4 years.
    2. Refund, if any, shall be subject to the retention of minimum premium of Rs.50/- as provided under Rule No.6 of Section I of AIFT.

Re: Section III of All India Fire Tariff

Arising out of a representation from an insurer it has been decided to insert two notes under the tariff item "Dwellings, Places of worships,......"(Risk Code 1, Rate Code 01) providing rates for "Data Processing/Call Centres/Business Process Outsourcing Centres". The modified tariff entry shall read as under:

Note 2: In case software development activity is carried on within the premises, the risks shall be rated under the tariff entry "Electronic Software Parks" (Risk Code 073/Rate Code 04) of Section IV of the AIFT.

Re : Inclusion of O&M Contractors as Co-assured under Operational Policies.

 

Arising out of a query from an insurer as to whether the name of the O&M contractors can be included as co-assured under operational policies (viz. IAR/FIRE /MB/etc.), it is clarified that:

1. O & M contractors should not be included as a co-assured under operational policies to ensure that subrogation rights of the owners / insurers under the operational policies are protected.

2. The legal liablity of the O & M contractors for acts, errors and omissions can be separately covered by a liability policy.

Re : Extension of Limit of Sum Insured for Add on Covers - "Omission to Insure additions, alterations or extensions"under AIFT.

Arising out of a request received from an insurer for enhancing the sum insured under "Omission to Insure additions, alterations or extensions" clause under AIFT from the present limit of 5% of BPM sum insured to 10%, it has been decided that the present limit of 5% shall be continued on account of the following reasons:

(a) 5% of BPM sum insured is adequate to take care of omission on the part of insured to insure any property which may be acquired during the year.

(b) Any increase in the percentage stipulated in the tariff would lead to the tendency of not insuring new property at the appropriate time.

                  Re: Shopkeeper’s Comprehensive Insurance Policy

          This has reference to TAC circular letter No.Fire/144/159-68 dated March 13, 1996 and circular Nos. FT/2/2001 and FT/28/2001 dated 9-2-2001 and 21-12-2001 respectively.

       The Authority has decided to revise the ceiling of Sum Insured from Rs.10 lakhs to Rs.2 crores in respect of aggregate value of property including contents/stock in trade under Shopkeeper’s Comprehensive Insurance Policy. There will be no other change in rates, terms and conditions of the policy.

     Insurers are requested to advise their operating offices suitably in this regard.

Re: Floater Declaration Policies issued to Central Warehousing/State Warehousing Corporations and Marketing Federations of State Govts.

Reference is drawn to TAC Circulars FT/4/2001 dated 9-2-2001 and FT/9/2004 dated 18-5-2004 prescribing special rates for covering the stocks in warehouses and godowns under floater declaration policies issued to the above named insureds.

Insurers may continue to charge the same rates for the policy period 2005-2006.

Insurers are also requested to furnish premium/claim statistics for the last years to review the special rates for the policy period 2006-2007.

Re :  Consideration  of  add-on cover `Impact Damage’  as add-on peril for the purpose of `policy rate’ under All India Fire Tariff

Further to our circular No.FT/12/2004 dated June 29, 2004 on the above subject, it is clarified that the  add-on cover `Impact Damage  due to Insured’s own Rail/Road Vehicles, Fork Lifts, Cranes, Stackers and the like and articles dropped therefrom’ of Section VIII shall  be considered  as add-on peril.  The rate for add-on  peril `Impact Damage’   is to be added to the policy rate in addition to the rates for other add-on perils viz. Earthquaqke, Terrorism, Spontaneous Combustion and Forest Fire  for providing add-on covers like Architects, Surveyors & Consulting Engineers fees, Removal of Debris,  Deterioration of Stocks in cold storage premises, Start up expenses etc.                              

 Insurers are requested to take note of the above clarification and advise their operating offices suitably.

             Re:  Submission of computation of Final Rate  -  All India Fire Tariff

            The Tariff Advisory Committee has decided to make premium computation table as per Rule 21 of General Rules and Regulations  of All India Fire Tariff  compulsorily an integral part of Standard Fire and Special Perils Policy.  For the sake of uniformity the premium computation table forming part of the policy document shall be provided in the format  indicated in Annexure 1 ( copy enclosed) for Basic Cover and Add-on cover(s).
